Sam Ukwuachu: Questions that need answering

Sam Ukwuachu, a former freshman All-American at Boise State University before transferring to play football at Baylor University, was convicted Thursday of sexually assaulting a former Baylor soccer player in 2013.

This is a hard thing to write. Anytime sexual abuse and rape are in the news, it is a hard thing to digest and understand fully. How do you write about something as messy and disgusting as rape? Even more difficult, how (or even why) should one have to even think about a football team in those writings?

The simple facts are, a Baylor graduate, and current student in the masters program, was found guilty of raping a now former Baylor student in 2013. The fact that this graduate student was brought to Baylor as a football player makes this much bigger news. As it should. You can easily make the case that Samuel Ukwuachu was only at Baylor because he could rush the passer, a skill he demonstrated during an All-American freshman campaign at Boise State.

Late Thursday evening, Ukwuachu was found guilty on one charge of sexual assault and will be sentenced Friday morning for possibly up to 20 years in prison. Questions are swirling about Baylor's investigation and response to the initial accusation, the football program's due diligence into finding out the true reason about Ukwuachu's dismissal from the Boise State team, and about the University's care and attention, or lack thereof, to the victim. No, not all of these questions can, or even will be answered right now. These types of cases are too complicated to get a simple answer.

Let's start from the beginning.

What happened at Boise State?

To those criticizing Art Briles and the Baylor football program, this is the only leg that I truly believe you have to stand on. Here is what we know. Boise State announced on May 7, 2013 that Ukwuachu was dismissed from the team for an unspecified violation of team policy. Rumors swirled about the reasons for his dismissal, but no facts were ever provided. In the end, Ukwuachu himself said “It was a personal issue that I don’t want to go in-depth with. But it wasn't a big issue. A minor problem occurred and the coaches decided I needed to get a fresh start with somebody else.”

According to the Waco-Tribune, during the trial, Ukwuachu said he stutters and it made him depressed and suicidal. He was hospitalized for three days. After he got out, he said he got drunk and punched a window and cut himself. He said the coaches were worried about his state of mind and asked him to leave the team.

In a recent Texas Monthly article on the allegations and trial that came out earlier this week allegations of physical abuse of a girlfriend at Boise State came to light. From the article:

This isn’t the first violent incident that Ukwuachu has been accused of. In documents from May 2013 obtained by Texas Monthly, Marc Paul, the assistant athletics director at Boise State University, recounts advising to Ukwuachu’s then-girlfriend in Boise that she stay away from the house the two shared for several nights, after he put his fist through a window while drunk. Paul also makes plans for how to get police protection for the couple’s other housemate, who received threatening text messages from Ukwuachu. Handwritten notes in a document from a Boise State source also refer to times that Ukwuachu would get verbally abusive over “small irritants” like a spilled drink, and note that the woman he lived with acknowledged that she would “probably not” admit it if the abuse were physical. At the trial, the former girlfriend stated that Ukwuachu "choked her and punched her in the head several times" and that "assaults led to Ukwuach being sent to anger management." However, she also stated that "she didn't call police or make a report." Based on the fact that the police were not aware of the alleged assaults, and there were no official reports of it, its difficult to know the extent to which the Boise State staff - particulary Chris Petersen - were aware of the allegations. What did Petersen know? Was he simply kicking a player off of his team that had emotional and anger issues, or was it related to the physical abuse of Ukwuachu's girl friend?

What did the Baylor coaches know about Uwauchu before bringing him to Waco?

Art Briles spoke this morning to several media members, stating that he spoke with Coach Petersen personally, and that depression and home-sickness were why he "needed to come home" to Texas. Coach Petersen released a statement this afternoon stating:

"After Sam Ukwuachu was dismissed from the Boise State football program and expressed an interest in transferring to Baylor, I initiated a call with coach Art Briles. In that conversation, I thoroughly apprised Coach Briles of the circumstances surrounding Sam's disciplinary record and dismissal."

Some are painting this in the light that Petersen is disagreeing with Briles and calling him a liar. However, the fact is, we are still no closer to knowing what Petersen knew and told Briles about Ukwuachu. Did Peterson know about the physical abuse stated in court of his girlfriend? Did he know the full scope of Ukwuachu's past? If he did, and communicated that information to Art Briles, then Coach Briles has been caught in a very bad lie, and will have to suffer some serious consequences.

I was contacted by Coach Petersen at Boise State in spring 2013 and he told me he had a player from Texas who needed to get closer to home and that he thought our program would be a good spot for him. I know and respect Coach Petersen and he would never recommend a student-athlete to Baylor that he didn't believe in. In our discussion, he did not disclose that there had been violence toward women (by Ukwuachu), but he did tell me of a rocky relationship with his girlfriend which contributed to his depression. The only disciplinary action I was aware of were team-related issues, insubordination of coaches and missing practice."

In addition, I talked with Tony Heath, his high school coach, who gave us a great recommendation.

As required with any transfer to Baylor, Boise State acknowledged that he was not suspended due to any institutional disciplinary reasons and further that he was eligible for competition if he chose to return to Boise State."

This statement also included paperwork sent over from Boise State during the transfer process, which would give credit to Briles' statement.

The other aspect of this is the full investigation of Ukwuachu as he looked to transfer to Baylor. Did Briles and company just speak with Coach Petersen and Ukwuachu? Who else did they reach out to? What about the roommate, who felt he was "afraid" at times living with him. Did they know Sam had a girlfriend, and if so, why did they not talk to her? I would assume speaking with a potential transfer's roommate and girlfriend would be standard practice in learning more about a person.

The fact remains that there is simply not enough information to definitively say one way or another if Briles is lying. All we're left with is public conjecture and what certain people want to think. In the end, Baylor's practice of accepting transfer student's for athletic purposes will forever be changed.

Both appeared to be horribly ineffective attempts at consoling the victim and making sure she got justice. Baylor did not make Ukwuachu change classes, instead putting the onus on her to do so. Also, the investigation into this matter appears to be missing several key elements. Below is a list of evidence Baylor investigators, led by Bethany McCraw, Baylor’s associate dean for student conduct administration, had at its disposal, (From Deadspin article):

  • She interviewed the woman and Ukwuachu.
  • She saw copies of text messages between the two of them.
  • She interviewed Ukwuachu’s roommate, Peni Tagive. She didn’t say what Tagive told her, but prosecutors said the roommate had told Baylor and a grand jury that he was in bed at 12:30 a.m. and heard no calls for help that night. His story fell apart in court, where prosecutors noted that Tagive’s cell phone records showed his phone, at the time he had claimed he was home, was connecting to towers in another part of town.
  • She spoke to a friend of the woman.
  • She had results of a polygraph test that defense lawyer Jonathan Sibley said Ukwuachu passed. (It’s worth noting that polygraph results, with very limited exceptions, are inadmissible in Texas criminal courts, as well as several other criminal courts across the country.)

    You might notice the rape kit and medical examiner's report are missing from this list. It was because McCraw asked the victim to provide it, and she did not have it with her. McCraw did not bother to request it again, or ask the victim to fill out the necessary paperwork for Baylor to request it from her doctor. She also did not interview the university psychologist, who diagnosed the victim with PTSD. Both of those are incredibly powerful pieces of evidence that could have easily swayed Baylor's investigation.

    This afternoon, Baylor University released a second press release stating that a "comprehensive formal inquiry into the circumstances associated with this case and the conduct of the offices in involved." This is a good start, and gives Baylor family members a hope that changes can be put in place and implemented to greatly improve their performance in these unfortunate incidents.

    Was this a cover-up?

    Many have pointed to a cover up by the Baylor administration. Their proof? That no one had heard about the awful details before last week. That Baylor athletics was involved in a cover up of a basketball player who was murdered by a former teammate. That Baylor has had a previous player accused of rape. As heinous and embarrasing these events are, the screams of cover-up laughable. It was in Baylor's best interest to keep things like this out of the news cycle until trial, to not only protect the victim, but also the accused. Do you think the accuser of Jameis Winston liked her death threats? That could have been avoided if the investigation by local police and the university were done correctly and quietly. Baylor's moral obligation is to the victim and the justice system, not the controversial media.

    Where do we go from here?

    There will be talk of ramifications within the Baylor football program, but any discussion of that is premature. In the end, a young man was found guilty of a horrible crime, and a young woman's life will never be the same. It is an awful story, and one that you hope you never have to write, whether about your school or another. All you can do is pray for the victim and her family, and hope that the guilty verdict can somehow help find her peace and move on to a better time in her life. At this point, that is what that matters here.
