Superior Court Hearing - Wednesday Oct 3, '07

Mr. John Sanger, senior partner in the firm representing UC, took the microphone this morning to revisit and add to UC's arguments about what may be the critical issue in these hearings - whether the Student Athlete High Performance Center (the SAHPC) is a free standing separate structure - or an addition to Memorial Stadium.

If the latter, several adverse consequences would result.

First, the EIR describing the project would probably have to be substantially modified because if the project is redefined to be a Memorial Stadium modification - rather than merely a new SAHPC - the EIR would have to reflect that. It doesn't now. Given the magnitude and complexity of a stadium retrofit, the rewrite could be a major and time-consuming project.

Second, the Alquist-Priolo seismic safety law allows modifications to structures that sit on an active earthquake fault trace only to the extent of 50% of the value of the structure. If the costs of the SAHPC were included, the funds available for the seismic retrofit - and for other improvements to the stadium - would be significantly decreased.

These would be serious project impacts, which may explain why Mr. Sanger was in court today to address these issues, even though most of them had already been discussed in detail in the last two weeks.

By way of contrast, many other (non-seismic) issues that have been raised at the hearings about possible inadequacies in UC's EIR are inherently capable of much simpler repair; if a section of the EIR had to be rewritten and the document amended and re-certified, that could happen quickly.

Moreover, after court decisions are rendered from the current hearings, there is always the possibility of either an appeal or a new lawsuit after UC takes whatever steps are required by the decision.

If UC merely has to repair a few elements of the EIR, another lawsuit on that same subject might be difficult to sustain since the issues would already have been raised, adjudicated, and corrected.

But if UC has to add a description of a Memorial Stadium retrofit to the EIR, a lot of new material would have to be added, and that new material might provide the City of Berkeley (et. al.) with a new basis upon which to file another suit.

This again reinforces the importance of the issue that was debated today: Is the SAHPC a separate structure, or part of a Memorial Stadium retrofit?

Mr. Sanger argued forcefully that the structures are separate. Unlike the other attorneys participating in these hearings, Mr. Sanger is a man of fewer (though not "few") words, speaking succinctly and pithily to the points he wanted to make.

He asserted that UC's project documents in the EIR had been "abused" by plaintiff's attorneys as they searched them to extract minute details that gave evidence that the stadium structure was going to be "altered" or "added to" by the SAHPC project.

Sanger reminded the court that the drawings being perused by plaintiffs were not engineering or architectural drawings - that they were merely renderings prepared for public presentations by UC about the new center.

Sanger advised the court that the SAHPC building had been designed from the beginning by its architects and engineers to be an independent and freestanding structure. He claimed that no licensed engineer in his right mind would ever even conceive of attaching it to the stadium, particularly in an earthquake zone. "Attachments" like that are just not ever done, he asserted.

He displayed the building's basic design document's front page that described the building, its purpose, capacity, and functions - all of which gave evidence of it being a separate structure.

"These are the kinds of documents reviewed by building inspectors when issuing building permits - and are the basis by which inspectors routinely decide whether a project is an addition or alteration to another structure - or an new separate structure," he said.

He also enumerated the construction phases involved in this project - starting with strengthening the foundations of the stadium west wall. Then "shoring" would be added - a long row of hundreds of underground piers, connected only to each other, located between the stadium and the closest wall of the SAHPC, intended to buttress the earth near the stadium so that excavation could occur on the downhill side for the SAHPC without causing damage to the stadium.

He explained that when shoring and excavation were done and the SAHPC built, g the shoring would be left in place, unconnected to anything, "abandoned completely" as he described it.

Finally, a new plaza would be created over - supported by - the roof of the SAHPC - a plaza that would extend over to and connect with the stadium.

Plaintiffs have argued - and did again today - that the plaza is the roof of the SAHPC and connects with and therefore makes the SAHPC an addition to the stadium.

Sanger pointed out that the plaza is not only separate from the SAHPC, it also - merely - provides walkway access to the two structures and is not a part of either.

He repeatedly argued that none of these structures would be connected in any way that would be considered meaningful by structural engineers or architects.

Prior to today's hearings, the judge asked plaintiffs and respondents to address a series of issues where she wanted to hear further arguments from both sides. Sanger responded to these first, then plaintiffs responded to the arguments described above as well as to the judge's questions.

Q1: Does Alquist-Priolo even apply to state agencies (like UC)?

Sanger argued that it does not, that UC has in the past and present been willing to voluntarily comply with statutes' strictures because its own internal policies are as definitive and as strict as the law itself.

He asserted that a plain language reading of the statute does not indicate that state agencies are "affected parties" under the law - and that the usual practice of the state legislature is to specifically include state agencies as affected parties if they wish that to be the case - and did not do so when they enacted Alquist Priolo (in 1972).

He commented that UC has not been making the claim in this hearing that UC is not subject to the law - because they do not believe there are any seismic or 1 vs. 2 building issues actually at stake here. He further commented that UC was only now responding to the question of the law's applicability to state entities because the judge had asked for arguments on the point.

Plaintiffs roundly criticized UC for "raising" this issue now - even though UC didn't do that - the judge did - because they divined an effort in these arguments by UC to avoid the impact of A-P. They also pointed out that throughout UC's EIR compliance with A-P is mentioned as a guiding principle.

Nevertheless, from several comments the judge made in court today, it is clear she intends to evaluate the idea that A-P does not apply to UC - and to state entities. In one interesting comment, she said that her court "cannot make law", and that if it decides that A-P does not apply to UC, it cannot then require that UC to comply with it.

Plaintiffs objected strenuously, as might be expected, and an hour or so of the hearing today was consumed by arguments over the number of times "cities and counties" are addressed as being subject to the A-P statute - as compared to the many fewer times that "state agencies" are mentioned - and the context of each. Each side cited to paragraphs, sentences, and phrases in the statute - and the count of each - to buttress their arguments.

Sanger reported that no court had ever been called upon to address the issue of whether state agencies were subjected to the law, that this is an area where there are no precedents.

Q2: Does the cost of seismic retrofitting count toward the 50% limit on renovation costs imposed by Alquist-Priolo?

UC argued that it did not. Sanger said that costs required by law - to make a structure seismically safe - are categorically different than costs of subsequent improvements or functional upgrades to such structures - and that it was only the latter that A-P limited. UC did not cite to specific language in the statute to that effect, but rather to similar cases in other areas that address such issues.

This argument, if accepted by the court, would have a major impact on the extent to which UC would be allowed to upgrade and improve Memorial Stadium and its facilities. A ruling on this issue, in UC's favor, would constitute a major innovation in A-P case law.

Plaintiffs again objected, arguing that A-P's limits apply to all alterations to a structure that sits over a fault trace, regardless of whom the project owner is, and whether or not the expenditures are for seismic safety or for functional upgrades.

In response to UC's assertion that the SAHPC is a separate structure, plaintiffs revisited many of the arguments they have already made in these hearings, often relying upon a literal reading of the statute. They argue that if there is any alteration or addition to Memorial Stadium, Alquist-Priolo is "triggered" and UC is required to assess the cost of the upgrades as compared to the value of the stadium.

So another hour was consumed by discussion of the "grade beam" that would be built under the stadium's west wall (to strengthen the foundation before excavation for the SAHPC) - and whether that beam was a) an "alteration" of the stadium, and/or b) part and parcel of the SAHPC project - with the plaintiffs again trying to assert that the two projects are in fact one.

For the first time, UC acknowledged today that the grade beam was an alteration to Memorial Stadium, but asserted that it was "de minimus" - so small in relation to the stadium's value that it did not merit the court's attention.

Plaintiffs, as might be expected, leapt enthusiastically upon this acknowledgement, claiming that it proved - "hands down" - that the stadium was being altered by the SAHPC project - and that therefore the judge should declare the hearing closed and send UC back to the drawing board. At least today that did not happen.

Plaintiffs cited to the many cases in UC's EIR where the text described phase one - the SAHPC - as the first and essential step to the seismic upgrade of Memorial Stadium - again trying to make the case that the two projects are in fact one.

In subsequent arguments about details, UC and plaintiff's attorneys again discussed whether the EIR documentation of issues like "biology" (the oak tree ecosystem) and "archeological resources" (such as possible Native American burials in the project site area) had been adequately addressed in the EIR.

The formal topic here was the "findings" in the EIR - the section that summarizes the results of the evaluations and alternatives described in the report. UC argued that both of these issues had been adequately covered in the EIR contained in UC's 2020 Long Range Development Plan; plaintiffs argued that the information in the LRDP was not sufficiently specific to the present project.

"Nowhere in the 2020 LRDP is there any mention of the removal of the oak tree grove - and the environmental impact of doing that."

UC plans to erect four "monumental" light towers on the east side of the stadium - permanent lights for late afternoon and evening football games - and reported that those towers have been designed to look as much as possible like the flag poles that already surround the stadium on its rim.

(UC's own historical-asset preservation guidelines suggest that nothing above the classic stadium rim be installed.)

UC also plans to put lighting in the "brow" of the proposed press box on the stadium's west side. These lights will not be on towers and will be focused on the field below. Using new lighting technology, UC asserts that "spillage" of light into surrounding areas (read Panoramic Hills homes) will be minimized - and much improved over the temporary rented lights that are now used for evening and night games.

UC attorney Charles Olsen said this afternoon that if legal findings eventually permit the erection of a two story structure (for fan seating and concessions) on the east stadium rim (on the paved areas behind student seating), "brow" lights will be installed there too, eliminating the need for the monumental towers on the east side.

Panoramic Hills Association residents as well as the city of Berkeley, are particularly concerned about the (up to) seven "capacity" events described in the EIR (over and above up to eight football games a year) at the Stadium after it is seismically retrofitted.

Their issues include noise, traffic, and the risks to life of a destructive earthquake that might occur during such events. The city asserts that as first responders in an emergency they have serious concerns in this areas.

UC claimed that the seven additional events are part of the "project objectives" that the University is free to define as it wishes - and that therefore the risks and environmental impacts of the events are "unavoidable."

Plaintiffs reacted strongly to this, saying "Unavoidable? All UC has to do is not have the events and the impacts are avoidable!"

The issue here is not whether UC has the right to hold the additional events - rather it is whether UC has appropriately and adequately described the events and their impacts on the environment and surrounding communities in their EIR.

A site visit will occur tomorrow, Wednesday, October 4th, where the judge, her security staff, campus police, attorneys for both sides, and a press pool cameraman will take a brief tour of Memorial Stadium and the alternative project sites described in UC's EIR.

UC observers at the hearing today described the site visits as an attempt by the judge to better visualize the structure and locations that have so far been visible to her only by graphics and photographs displayed in the courtroom.

Final arguments have been rescheduled from next Tuesday to next Thursday, October 11th. The law requires a decision within 90 days thereafter; optimists expect a decision in about two weeks.
