Despite exoneration from a lack of institutional control, or direct involvement/ knowledge of a coach or academic personnel, NCAA calls for vacating victories.

For 23 excruciatingly long minutes, Brian Kelly was left to fend for himself and the University of Notre Dame, spinning out of control like a plane that has lost its rudder, like a ski jumper whose fateful first move off the lift spells immediate doom.

Tuesday, at his weekly press conference, Kelly tried desperately to keep the talk on the final opponent of the 2016 season, USC, Notre Dame’s 17-point-favored adversary this weekend.

Ultimately, his efforts proved futile.

“I thought we were going to talk USC,” said Kelly after the NCAA’s announcement that a student football trainer had acted unethically and committed academic misconduct -- along with nine former Notre Dame football players -- thus placing the football program on probation for a year and vacating victories from the 2012-13 seasons.

“Anybody else have USC questions? Everybody’s done with USC? Seriously?”

A reporter temporarily bailed out Kelly with a football-related question. But it was a brief reprieve.

“Just tell me when you guys…are we done with USC?” Kelly said. “Everybody’s done? Is that a yes? You guys are kidding me. That’s all you want to talk about?

“All right, let’s go. Hand the mic over. Let’s go.”

The uncomfortable tone of the moment made those in attendance squirm, but not any more than Kelly, who once again was being asked – some two years and three months since the investigation for the suspicion of academic fraud first broke – to represent the University in the most difficult of times.

“As we said at the outset of this investigation, Notre Dame would willingly accept a vacation of records penalty if it were appropriate,” Jenkins said. “It is not in this case.

“We disagree with the decision of the hearing panel to impose, at its own discretion, a vacation of records penalty. In past academic misconduct cases, the Committee on Infractions has imposed this penalty only when it has found serious institutional misconduct, such as actions with the direct involvement or knowledge of a coach or academic personnel, a failure to monitor or a lack of institutional control.

“The NCAA enforcement staff and the hearing panel agreed with Notre Dame that no such institutional misconduct occurred in this case. Indeed, the only reason the NCAA reviewed the matter was because the misconduct involved a former fellow student who happened to participate in the University’s student trainer program—an activity which involved no responsibility for the academic work of student-athletes.”

Only Kelly – the beleaguered football coach staring at a 4-8 season once USC takes its pound of flesh – trying to publicly explain how a student athletic trainer could be deemed, in essence, on the same level as a coach or academic personnel.

“It’s never happened before in the history of the NCAA,” Kelly said. “A penalty has never been issued in this fashion before.

“It was student-on-student cheating. There was (no coach or academic personnel) implicated. The NCAA agreed with that finding, and it was clearly excessive.”

Indeed, if this exact scenario were to occur today, there would be no NCAA investigation, no probation, no vacating of wins. The status of a “student athletic trainer” has been altered by the NCAA since this occurred.

“When you hear that this is based upon language and legislation that has since been changed, and if it were just a year or two ago, this would not even be a violation, it makes you wonder why this is even where it is today,” Kelly said.

Additionally, had Notre Dame chosen to immediately expel the nine former football players who participated in the academic improprieties, there would be no NCAA investigation, no probation, no vacating of wins.

But Notre Dame chose, instead, to allow due process, to allow the student-athletes to have their day in court and to clear their names and exonerate themselves.

Kelly complicated matters by declaring that “80 percent of colleges go through cheating.” He differentiated between the current struggles on the field and the NCAA decree, but the “80 percent” reference rung hollow.

“Today’s statement should be a validation that my collateral responsibilities at Notre Dame as head coach are outstanding,” Kelly said. “However, (I’ve) got to win more football games. That hasn’t changed.”

Kelly does have culpability for bringing in marginal student-athletes who truly are at risk of succeeding academically at Notre Dame. Most are willing to try without outside influences, but not all.

It’s a fine line, a slippery slope. If you don’t recruit such stellar athletes, you’re not going to play for national championships. Still, if you recruit them, you’re responsible for their actions.

That’s a responsibility – massive though it is – that comes with the equally massive paycheck.

It’s his program. His players, ones that he recruited as opposed to the ones he threw under the bus his first season when their failures on the field were attributed to his “us and them” depiction, fall under his jurisdiction.

He can’t control them all, but he’s responsible for them all.

Ultimately, there’s plenty of blame to go around, including the NCAA, which has to be outside its collective mind to choose Notre Dame as the example upon which it has pinned its effort to “clean up” intercollegiate athletics.

Some will say the only thing Notre Dame lost were games already played, and as Kelly said, the Irish were 12-1 in 2012 and that’s the way it will always be remembered. But that’s not the point.

Notre Dame self-reported everything that happened. There’s no indication of cover-up. Notre Dame was transparent and paid a price. Notre Dame was an easy mark for the NCAA, and for that, the organization should be ashamed.

The NCAA chose to hit Notre Dame where it hurts the most – in its tradition.

Don’t be surprised if this verdict ultimately is overturned. That way the NCAA will look both a) vigilant in punishing Notre Dame and b) magnanimous in reducing the penalty.

The probation is little more than a warning that the NCAA will be watching. Any further transgressions will be met with more substantive punishment. No reduction of scholarships and no bowl limitations (other than what the Irish impose upon themselves by playing such bad football). If the Irish qualify for a bowl game next year, they’ll be able to attend.

Where Notre Dame suffers the most is its image and the way the masses will forever view the school and its athletic programs. Notre Dame cheated and they got caught. That’s what they’ll say, even if the verdict is overturned.

The nation’s best recruits won’t come to Notre Dame, but they weren’t anyway. They’ve been going to places where true student-athletes haven’t existed for a long time, if ever.

A decision like this won’t impact most sports at Notre Dame. Notre Dame’s other sports – the ones that draw the least attention – will be just fine. They’re thriving now; they’ll continue to thrive.

Notre Dame football – already struggling to keep up with the miscreants – will suffer more. Borderline Notre Dame student-athletes won’t get the benefit of the doubt any longer.

You say you want a new head coach? Good luck finding a better one under these conditions.

In the meantime, Notre Dame is left with tears of sadness -- on the field, off the field and even in the record books.
